Scaffolding’s Standard License

  1. Introduction
    This document is intended to allow use and auditing of the source code by the licensee, but restricts modification of the source code. This license seeks to balance transparency and security by providing access to the code for understanding and auditing purposes, without allowing alterations.
  2. Definitions
    • Use: The execution of the software by the end user for the purpose for which it was designed.
    • Access: The ability to view and interact with the source code of the software, without making changes to it.
    • Modification: The alteration or customization of the software source code.
    • Source code: When referring to source code, this includes all files that make up the Scaffolding theme, including, but not limited to, Stencil templates, HTML markup files, SAAS and CSS style files, JavaScript scripts and programs, JSONs files, and any software components developed by BC-Devs that have been integrated into the theme.
  3. Rights Granted
    • Licensee is granted a non-exclusive, non-transferable, non-sublicensable right to use the software and access its source code.
    • The licensee is expressly prohibited from modifying, merging, distributing, sublicensing, selling or transferring the software or its source code, whether for or by third parties or for its own use.
  4. Intellectual Property
    Scaffolding is exclusive to BigCommerce stores and its code may be accessed but not modified unless you purchase an Evolutive License from Scaffolding, in which case you may alter the code to suit your business needs. Failure to comply with this policy will result in legal action.
  5. Restrictions
    Licensee may not modify the source code of the software for any purpose, including, without limitation, modification of styles, markups, templates, JS scripts, or any other component of the theme that was created by BC-Devs.
  6. Intellectual Property Protection
    The software and all related content, including source code, are the intellectual property of the licensor and are protected by United States copyright laws and international treaties.
  7. Exceptions and Limitations
    Licensee may make modifications to the source code for personal, non-commercial use only if expressly authorized by BC-Devs.
  8. Warranties and Liabilities
    • The software is provided "as is", without warranties of any kind, either express or implied.
    • Licensor shall not be liable for any indirect, incidental, special, consequential or punitive damages arising out of the use or inability to use the software.
  9. Duration of License
    This license shall remain in effect until terminated by the licensor or the licensee. The licensee may terminate the license at any time by destroying all copies of the software.
  10. Applicable Jurisdiction
    This license shall be governed by and construed in accordance with the laws of the United States of America, without giving effect to any principles of conflicts of laws.
  11. Theme Installation
    It is the responsibility of Customer, and not BC-Devs, to ensure that installation of a the theme does not overwrite or damage Customer's current or pre-existing theme.
  12. Theme Updates
    It is the responsibility of the Customer and not BC-Devs to manually or automatically apply theme updates to your store. BC-Devs is not responsible for any damage to current theme customization or UI when applying theme updates.
